Landlord Agreement

This agreement applies to every landlord, property owner, and real-estate agent (“you” or “Lister”) who posts a rental or for-sale listing on Estatya. By submitting a listing you confirm you have read, understood, and agreed to these terms.

Eligibility

You may post a listing only if you are: (a) the legal owner of the property, (b) a property manager with written authority to lease on the owner’s behalf, or (c) a licensed real-estate agent or broker acting within your licensed scope. Listing a property you do not have the right to lease is a material breach of this agreement and may constitute fraud.

Listing accuracy

Every listing must be accurate, current, and complete. You agree to:

  • Provide the correct property address, unit number, and square footage.
  • Set the base rent at the amount you will actually charge — not a teaser rate intended to attract inquiries.
  • Remove or mark rented any listing within 48 hours of executing a signed lease.
  • Update any listing whose material details change (rent, availability date, pet policy, etc.) within 5 business days.

Estatya may remove listings that are materially inaccurate, duplicated, or appear designed to mislead renters. Repeated inaccuracies may result in account suspension.

Fee disclosure — Virginia Residential Landlord Tenant Act (VRLTA)

Virginia Code § 55.1-1204 (as amended effective July 1, 2025) requires landlords to itemize all mandatory fees in writing before a tenant submits an application. By submitting a listing you confirm that:

  • Every required recurring or one-time fee (admin, pet, parking, amenity, trash, etc.) is listed in the fee section of the listing form.
  • The fees shown are the actual amounts a tenant will owe — not estimates.
  • No mandatory fee will be introduced at application, lease signing, or move-in that was not disclosed in the listing.

Failure to disclose required fees may expose you to liability under the VRLTA. Estatya is not responsible for your compliance obligations but reserves the right to remove listings that generate credible fee-transparency complaints.

Fair Housing Act compliance

You agree to comply with the Fair Housing Act (42 U.S.C. § 3604) and all applicable state and local fair-housing laws. This means your listing description, photos, and any communications with renters must not indicate a preference, limitation, or discrimination based on race, color, national origin, religion, sex, familial status, disability, or any other protected class.

Estatya automatically scans listing descriptions for potentially prohibited language and may place a listing in review or block publication if a violation is detected. You may appeal a flagged listing by editing the description and resubmitting. Listings that cannot be brought into compliance will be removed and the account may be terminated.

You agree to indemnify and hold harmless Estatya against any claims, penalties, or damages arising from your violation of fair-housing laws.

Photos and listing content

By uploading photos or other content you confirm that:

  • You own the photos or hold a valid license to use and publish them in connection with this listing.
  • The photos accurately depict the listed property — not a model unit or a different address.
  • The photos do not contain personally identifiable information (faces, mail, documents).

You grant Estatya a non-exclusive, royalty-free license to display your listing content (photos, description, fee schedule) for the purpose of operating the platform and promoting listings to renters. This license terminates when the listing is deleted or your account is closed.

Renter contact information

When a renter submits an inquiry, Estatya shares their name, email address, and optional phone number with you for the purpose of evaluating and responding to their interest in your listing. You agree to:

  • Use renter contact information only to communicate about the specific listing they inquired about.
  • Not add renter email addresses to any mailing list, marketing campaign, or third-party CRM without the renter’s explicit, separate consent.
  • Not sell, share, or transfer renter contact information to any third party.
  • Delete renter contact information if the renter requests it in writing.

Tenant screening

Estatya provides a referral link to our licensed screening partner for tenant background checks. The screening is conducted entirely by that partner; Estatya never receives, stores, or processes credit reports, criminal background reports, or Social Security numbers. You are solely responsible for complying with the Fair Credit Reporting Act (FCRA), including providing required adverse-action notices if you deny an applicant based on a screening report.

Subscription and payment

The Free plan allows up to three active listings at no charge. The Pro plan is billed monthly at the then-current rate shown on the pricing page. Subscriptions renew automatically until cancelled. You may cancel at any time through the billing portal; access continues until the end of the current paid period. Estatya does not issue refunds for partial billing periods.

If a payment fails, Estatya will attempt to retry the charge and will notify you by email. Listings may be suspended if a Pro plan subscription lapses and is not renewed within the grace period shown in the billing portal.

Suspension and removal

Estatya may suspend or remove a listing, or suspend or terminate an account, immediately and without prior notice if:

  • A listing violates fair-housing laws or this agreement.
  • We receive credible evidence that a listing is fraudulent or does not exist.
  • An account receives multiple valid renter complaints regarding accuracy or conduct.
  • Required payment is not received after the applicable grace period.
  • We are required to act by law, regulation, or court order.

Indemnification

You agree to indemnify, defend, and hold harmless Estatya, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from: (a) your listing content; (b) your breach of this agreement; (c) your violation of any applicable law, including fair-housing or FCRA; or (d) any dispute between you and a renter.

Changes to this agreement

Estatya may update this agreement at any time. We will notify active lister accounts by email at least 14 days before material changes take effect. Continued use of the platform after the effective date constitutes acceptance of the revised terms.
