DMCA Policy

Estatya respects intellectual property rights and complies with the Digital Millennium Copyright Act (17 U.S.C. § 512). If you believe content on our platform infringes your copyright, you may submit a takedown notice using the procedure below. We will respond promptly to valid notices.

Designated agent

Estatya has registered a designated agent with the U.S. Copyright Office as required by 17 U.S.C. § 512(c)(2). All DMCA notices must be directed to:

Submitting a takedown notice

If you are a copyright owner (or authorized to act on their behalf) and believe content on Estatya infringes your copyright, send a written notice to [email protected] that includes all elements listed below.

Notice requirements

To be valid under 17 U.S.C. § 512(c)(3), your notice must include all of the following:

  1. Identification of the copyrighted work. Describe the work you claim is infringed. If multiple works are covered by a single notice, list each one.
  2. Identification of the infringing material. Provide the exact URL(s) on Estatya where the allegedly infringing content appears, with enough detail for us to locate it.
  3. Your contact information. Full legal name, mailing address, telephone number, and email address.
  4. Good-faith belief statement. A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  5. Accuracy statement. A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on their behalf.
  6. Signature. Your physical or electronic signature.

Notices that are missing any required element will not be processed. We will contact you if we need clarification.

Counter-notices

If content you posted was removed following a takedown notice and you believe it was removed in error — for example, because you own the copyright or have a license to use it — you may submit a counter-notice to [email protected]. A valid counter-notice under 17 U.S.C. § 512(g)(3) must include:

  1. Identification of the removed material and the URL where it appeared before removal.
  2. Your contact information. Full legal name, mailing address, telephone number, and email address.
  3. Good-faith belief statement. A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
  4. Consent to jurisdiction. A statement that you consent to the jurisdiction of the federal district court for your judicial district and will accept service of process from the person who submitted the original notice.
  5. Signature. Your physical or electronic signature.

If we receive a valid counter-notice, we will forward it to the original complainant and may restore the content after 10–14 business days unless the complainant files a court action before that time.

Repeat infringers

Estatya will terminate the accounts of users who are found to be repeat infringers in appropriate circumstances, consistent with 17 U.S.C. § 512(i).

Misuse of notices

Filing a false or materially misleading DMCA notice is a violation of 17 U.S.C. § 512(f) and may expose you to civil liability including damages, attorney fees, and costs. Submit notices only for content you genuinely believe infringes a copyright you own or control.
